Whilst many of these matters are relatively straightforward, others can be more complicated. Although some heads of claim are obvious, others are not as apparent and may be missed if only a superficial investigation of the claim is performed.
At O’Hare Donohoe we adopt a flexible approach, which dovetails with the work performed by a solicitor. We are able to provide solicitors with a range of products, from calculations to be included within Schedules of Special Damage to formal expert's reports. Within this, we are willing to concentrate solely on individual heads of claim, as specified in our instructions, or, if required, prepare a comprehensive assessment.
Whatever our involvement and the product we provide, all work is performed to the same high professional standards with attendant attention to detail.
Our flexibility does however have one boundary, namely we always assess claims based on the evidence available and consequently the opinion we give is unaffected by whether we act for the Claimant or Defendant. We have always conducted ourselves as experts of the Court.
The basic principles we adopt and work we perform are often the same whether we are assessing the earnings and pension of an injured or deceased party.
In fatal accident cases, however, we utilise the earnings and pension information to prepare the loss of dependency calculations. We have an up to date knowledge of the relevant case law and this is essential to ensure that the correct methodology is followed in performing the calculations.
